of California consumers has been filed against Cost Plus World Market for
selling unassembled furniture while failing to disclose in its advertising that
the furniture is unassembled (Los Angeles County Superior Court, #BC-333-614).
Failure to disclose this fact is a violation of California's Consumer Legal
Remedies Act (the "CLRA").
The CLRA has been used by consumers for over 30 years to prevent false and misleading advertising. Peter L.Weinberger & Associates, the firm that filed the lawsuit, seeks a court order forcing Cost Plus to comply with the law and seeks compensation for Cost Plus' customers who purchased unassembled furniture. The lawsuit alleges that Cost Plus knows that it is required to disclose in its advertising that its furniture is unassembled, but intentionally ignores the law to boost sales. The suit seeks punitive damages, additional damages for senior citizens and disabled persons who were misled by Cost Plus' advertisements, and requests that Cost Plus make charitable contributions to make amends for allegedly misleading its customers.
The length of time in which Cost Plus has been deceiving the public is yet to be determined. "We do not yet know if Cost Plus has been falsely advertising its products for the more than thirty years that the Consumer Legal Remedies Act has been in place,” admits Doug Mastroianni, an attorney at Peter Weinberger's office. "We do know that Cost Plus has more than 60 retail locations in California so we think its advertising has probably reached nearly every community in the state."
